Retaliatory Act
Definition
A Retaliatory Act is any action taken by a government actor that imposes harm, disadvantage, or pressure on an individual in response to that person’s lawful exercise of a constitutional right. Retaliatory Acts may be overt or subtle, formal or informal, and often appear administrative, procedural, or discretionary — but their defining feature is intent: the act is meant to punish, silence, or deter protected conduct.
