Institutional Failure
Definition
Institutional Failure occurs when a government body, oversight mechanism, or constitutional actor does not fulfill its duty to prevent, address, or correct a breach of constitutional rights. It includes failures to intervene, failures to enforce limits, failures to protect victims, failures to investigate wrongdoing, and failures to uphold accountability. Institutional Failure does not require malicious intent; it can arise from neglect, indifference, political pressure, structural weakness, or deliberate inaction. Its defining feature is that the institution’s nonresponse allows unconstitutional harm to persist, deepen, or spread.
